The basics
Understanding the TAC No-Fault Scheme
Victoria's Transport Accident Commission runs a no-fault scheme for people injured in transport accidents. If you've been hurt as a driver, passenger, motorcyclist, cyclist, pedestrian, or public transport user, you may be able to claim:
- Medical costs and rehabilitation
- Income support while you're unable to work
- A lump sum for permanent impairment
- Compensation through a common law claim, where someone else was at fault
Not sure what applies to you? Get in touch for a free case review.
Enquire nowThe scheme's medical and income entitlements don't depend on who caused the accident. Fault only becomes relevant if you're pursuing a common law claim against another party.
What can you claim?
What You Can Claim Under the TAC Scheme
Compensation under the scheme generally falls into three categories.
Medical Expenses and Income Support
- Treatment, rehabilitation and hospital cover
- A portion of lost earnings while you're off work
- Funding for home or vehicle modifications where needed
Impairment Benefits (Lump Sum Payments)
- A one-off payment based on the severity of your permanent injury
- Assessed independently of your income support or other entitlements
- Can be disputed if the assessed figure is too low
Common Law Claims for Serious Injury
- Available if another party was at fault
- Requires meeting the serious injury threshold
- Covers pain and suffering as well as future economic loss

Straight answers to what comes up most.
Standard TAC benefits don't depend on fault. A common law claim is different, and requires another party to have been at least partly responsible, in exchange for the ability to claim pain and suffering and future economic loss.
